My Practice
I maintain a very diverse and active trial practice. I litigate and try large and small cases, representing plaintiffs and defendants. My clients have received good results from my hard work on their behalf. I love to try cases, love to win, and I am firmly committed to work as hard as I can to achieve the best results for my clients.
I litigate complex commercial and construction matters, nursing home negligence issues, class action claims, consumer transaction disputes, medical and professional negligence issues, and general negligence and product liability cases. My recent cases have involved a wide spectrum of issues including breach of contract, consumer fraud, nursing home negligence, breach of covenant-not-to-compete, violations of uniform trade secrets act, legal malpractice, breach of fiduciary duty, class actions for violations of the Federal Fair Debt Collection Practices Act, price-fixing class action, and toxic mold contamination.
I work on both an hourly basis and a contingent fee basis, or any combination of the two. I enjoy sharing the risks of litigation with my clients and approximately half of my time is spent on contingent fee cases.
These are the results of some of my recent cases:
April 2004 - Represented a 91 year-old rancher and farmer against several of his family members who attempted to gain control of his $4 million personal estate. My client was involuntarily placed in a locked-down Alzheimer's unit in Colorado by his family members and at the same time the family members used a general power of attorney to transfer all of my client's $4 million estate into an irrevocable trust controlled by the family. After my client successfully gained his release from the locked-down unit via a habeas corpus action, I filed suit for breach of fiduciary duty, invasion of privacy, outrageous conduct and medical negligence in the United States District Court on behalf of my client against several of his family members and medical treatment providers. My client reached confidential settlements prior to trial with all of the defendants except one of his siblings. Obtained a judgment against the lone sibling in the amount of $281,300. The judgment is currently on appeal in the 10th Circuit Court of Appeals.
October 2003 - Resolved Kansas state-wide class action claim on behalf of approximately 1700 consumer debtors against a Kansas City debt collection law firm for violations of the Fair Debt Collection Practices Act.
July 2003 - Settled consumer class action against K.C. Hopps, Ltd. for overpricing and overtaxation of alcoholic beverages.
May 2003 - Resolved nursing home abuse and neglect case on behalf of deceased client and her family against a multi-state corporate skilled nursing home facility. This case was settled for a mid six-figure amount in the early stages of discovery - prior to the taking of any depositions.
February 2003 - Despite clear liability and damaging evidence presented at trial, obtained favorable verdict for the defendant in an automobile personal injury trial. I admitted liability and tried only the issue of damages before the jury. Plaintiff requested a quarter-million dollars at trial. Jury returned a verdict for just over $80,000.00.
October 2002 - Successfully represented general contractor in arbitration claim against owner on commercial construction project before the American Arbitration Association. Client had substantial claim for default on payment after completion of project. Owner counterclaimed for nearly same amount as outstanding on invoices. Won award for full amount of client's claim and successfully limited owner's counterclaim to minimal amount for non-credited modifications in change orders.
July 2002 - Successfully defended a former regional manager of a national company in a civil suit alleging breach of non-compete agreement and violations of trade secrets act. The plaintiff claimed damages between $1.3 million and $1.7 million. Case was filed in United States District Court of Kansas and following extensive discovery, I prevailed on a summary judgment motion. Plaintiff subsequently prosecuted my client for civil contempt based on alleged violations of a temporary injunction. After a one-day trial, my client was found in contempt, but I successfully argued that the plaintiff had not proven that my client's actions had caused any damage to the plaintiff.
July 2002 - Represented elderly client whose family members attempted to gain control of his multi-million dollar personal estate. My client's family members used a general power of attorney to transfer approximately $4 million of my client's estate into an irrevocable trust controlled by the family. I filed suit in the United States District Court for my client against his niece, the trustee of the purported trust. The trust was declared void ab initio and all of my client's assets that had not been misappropriated by the defendant trustee were recovered. We alleged that the trustee had misappropriated a little over $100,000. The trustee voluntarily returned $50,000 and after a day and half trial before the court, the court entered a judgment in favor of my client for over $60,000. This case is currently before the 10th Circuit Court of Appeals.
February 2002 - Favorably settled racial discrimination case against national department store after extensive discovery.
July 2000 - Won defense verdict and award for counterclaim on behalf of electrical contractor in jury trial for breach of contract by private individuals for service upgrade and rewiring of their entire residence. My thrilled client avoided a sizeable claim in a plaintiff's oriented jurisdiction, and recovered on his counterclaim.
